WHAT VISA CATEGORY CAN I APPLY FOR?

This category of visa may be applied for if you hold the necessary skills, experience and qualification in line with one of the categories listed on the Critical Skills List. If you have an offer of employment with a South African company, the visa may be issued for a period of up to five (5) years and is renewable. Should you still wish to seek employment in South Africa, you may be issued with a one (1) year non-renewable visa to enable you to seek employment.

Despite the name, this is one of the most complex and onerous work visa categories to apply for. To qualify for this visa, you must have received a Certificate from the Department of Labour (DoL) confirming that there is no suitable South African available to fill your proposed role and that your proposed salary is market-related, alternatively a Waiver issued by the Department of Home Affairs to substitute the DoL Certificate requirement. This is a multi-layered and lengthy process.
 

If you are married to a South African Citizen and wish to join them in the Republic, you are eligible to apply for a Spousal Visa. This visa will restrict any work/business related activities which must be applied for in the form of a contract of employment and/or business registration documents from the South African Company. This visa option is also applicable for life-partners who can prove that the relationship is in existence for two (2) years and longer.

This category of visa applies to students who have been accepted to study at South African Educational Institutions. As a student, you are permitted to work on an ad-hoc basis for up to 20 hours weekly.

Non-visa exempted nationals are required to apply for a short-term visa to travel to South Africa for business/holiday purposes. This visa is issued for 3 months and could be extended for 3 months in South Africa if required. No work activities are allowed on this visa.

If you are required to attend to an urgent project in South Africa in a short-prescribed timeframe (3 – 6 months), the ideal visa will be a Short-Term Work Visa which will enable you to legally conduct work activities in the country without implicating yourself or the South African Company.
