IMMIGRATION ROUTE FOR STAFF MEMBERS TO SOUTH AFRICA
An Intra-Company Transfer Work Visa is a type of work visa that allows a staff member to transfer from an international company to a branch, subsidiary, or an affiliate of that company in South Africa. This work visa category allows foreign employees of multinational corporations to live and work in South Africa for a set period of time and is a popular option for multi-national organisations.
Our immigration experts are ready to assist you throughout the entire application process.
Qualifications verification by SAQA and/or professional body registration are not required.
Visa holders are free to exit and re-enter South Africa freely.
There is no need for skill verification or assessments by the Department of Employment and Labour.
WHO SHOULD APPLY FOR AN INTRA-COMPANY TRANSFER WORK VISA?
The Intra-Company Transfer Work Visa is ideal for multinational corporations, because it provides a temporary immigration route for staff members to South Africa. Employers should keep in mind, however, that the intra-company transfer option is only applicable if the employee is required in South Africa for no more than four years.
If the employee is required for more than four years, the Intra-Company Work Visa will not be appropriate, and you should consult with our immigration experts about other visa options.
HOW TO QUALIFY FOR AN INTRA-COMPANY TRANSFER WORK VISA?
Applicants for an Intra-Company Transfer Work Visa must have worked for the foreign entity for at least six months and provide proof of employment in the form of an employment contract.
A skills transfer plan outlining how the organization intends to transfer similar skills from the foreign employee to a South African citizen or permanent resident must be included in the application for the Intra-Company Transfer Work Visa.
INTRA-COMPANY TRANSFER WORK VISA FREQUENTLY ASKED QUESTIONS
My Intra-Company Transfer Work Visa has been issued for only two years, can it be extended within South Africa?
Yes, an Intra-Company Transfer Work Visa can be extended for an additional two years. The application can be submitted within South Africa, subject to the visa’s terms and conditions.
I would like to change from an Intra-Company Transfer Work Visa to a Critical Skills Visa or any other visa category. Can this be done within South Africa?
The Immigration Act makes no mention of the inability to switch from an Intra-Company Transfer Work Visa to a Critical Skills Visa; however, practice within the Department of Home Affairs suggests otherwise.
This means that if you want to change to a Critical Skills Visa, which provides a path to Permanent Residency, or any other visa category, you must apply from within your home country.
My Intra-Company Transfer Work Visa expired after four years. The South African project, on the other hand, still requires work. What steps can I take to extend my right to live and work in South Africa to complete the project?
You may apply for a new Intra-Company Transfer Work Visa if you include proper company motivation as to why the four-year period was insufficient time to complete the assigned period. The new application must be filed in your home country from abroad.
Eligibility and supporting documentation for Intra-Company Transfer Work Visas can be complicated, so it is best to seek an immigration expert’s advice before applying.
